Terms of Service

1. Acceptance of Terms

By accessing or using Clarix at clarix.digital ("the Service", "Platform", "Clarix"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you") and Clarix ("we", "us", "our") under the Information Technology Act 2000 and the Consumer Protection Act 2019 of India.

By clicking "Continue with Google" or otherwise signing in, you confirm you have read, understood, and agreed to these Terms.

2. Description of Service

Clarix is an AI-powered SaaS (Software as a Service) platform that provides prompt engineering and content enhancement services. The core function is:

• Accept text input from users (prompts, captions, content ideas)
• Process the input through our secure server using AI models (Google Gemini, Groq, or Anthropic Claude)
• Return a grammar-corrected, contextually enhanced, language-localised output optimised for your chosen AI platform
• Apply Country + Language context for regionally relevant output

Data handling: Your account profile, preferences, and usage statistics are stored securely in our cloud database (Google Firestore). Your prompt text is processed in real-time and not permanently stored on our servers. Please read our Privacy Policy for full details.

2A. Guest Mode

Clarix offers a Guest Mode that allows new visitors to use up to 5 AI prompt enhancements for free without creating an account. By using Guest Mode:

• No account or personal data is required or collected
• Your guest usage count is tracked locally in your browser only
• Guest Mode prompts are subject to the same Acceptable Use Policy as registered users (Section 6)
• Once the 5-prompt guest limit is reached, you must sign in with Google to continue
• Guest usage is not transferable to a signed-in account

2B. Push Notifications

Clarix may request your permission to send Web Push Notifications to your device. By granting permission:

• You consent to receive feature announcements, platform updates, and re-engagement messages from Clarix
• Your browser generates and provides a push subscription endpoint which is stored securely in our database
• You may withdraw consent at any time via your browser notification settings (Settings → Notifications → clarix.digital → Block)
• We will not send more than a reasonable number of notifications per month and will never send promotional messages from third parties
• Push notifications are opt-in only — declining has no effect on your use of the platform

3. Eligibility

• You must be at least 13 years of age to use Clarix
• If you are under 18, you must have parental or guardian consent
• You must have a valid Google account to sign in
• You must not be banned or previously suspended from Clarix
• You must be capable of entering into a legally binding contract under applicable law

4. User Account

When you sign in with Google, a Clarix account is automatically created for you. You are responsible for:

• Maintaining the security of your Google account
• All activity that occurs under your account
• Providing accurate information during onboarding
• Notifying us immediately at support@clarix.digital if you suspect unauthorised access

Clarix reserves the right to suspend or terminate accounts found to be in violation of these Terms.

5. Free and Paid Plans

Clarix offers the following service tiers:

• Free Tier: 25 lifetime trial prompts, then 5 AI enhancements per day. No credit card required. Available now.
• Creator Plan (₹299/month): Unlimited daily enhancements, prompt history, full library access. Coming soon — payment system in development.
• Pro Plan (₹999/month): All Creator features + Expert Breakdown + advanced studio tools. Coming soon.
• Agency Plan (₹2,999/month): All Pro features + API access + team seats + white label option. Coming soon.

Paid plans will be activated through Razorpay once our payment infrastructure is complete. You will be notified in-app when paid plans become available. All paid plans will include a 7-day free trial.

6. Acceptable Use Policy

You agree to use Clarix only for lawful purposes. You must NOT use Clarix to:

• Generate, distribute, or facilitate content that is illegal, abusive, defamatory, or harmful
• Create prompts for generating child sexual abuse material (CSAM) — we will report this to law enforcement
• Produce content that promotes terrorism, communal violence, or hatred
• Impersonate any person, brand, or government entity
• Attempt to reverse-engineer, scrape, or extract our AI systems or codebase
• Use automated scripts or bots to abuse the service
• Violate any applicable law — Indian or international — including the IT Act 2000
• Circumvent rate limits, trial limits, or any other usage restrictions
• Share your account credentials with others

Violation of this policy may result in immediate account termination without refund and, where applicable, reporting to relevant authorities.

7. AI Output Disclaimer

Clarix uses third-party AI models (Google Gemini, Groq / Meta LLaMA, Anthropic Claude) to process your input and generate output. Please be aware:

• AI-generated output may not always be accurate, complete, or appropriate for your use case
• Clarix does not guarantee the quality, accuracy, or fitness for purpose of any AI-generated content
• You are solely responsible for reviewing, verifying, and using any AI output
• Clarix is a prompt enhancement tool — it is not a substitute for professional advice (legal, medical, financial, etc.)
• Output in regional languages may occasionally have errors — verify before publishing

We actively filter profanity and harmful content from outputs, but cannot guarantee 100% filtering accuracy.

8. Intellectual Property

Your content: The prompts you enter and the enhanced outputs you receive belong to you. Clarix asserts no ownership over your prompt text or generated outputs.

Our platform: The Clarix brand, logo, design system, codebase, AI prompting methodology, and platform architecture are the intellectual property of Clarix and are protected under applicable Indian IP laws.

Licence grant: By using Clarix, you grant us a limited, non-exclusive, royalty-free licence to process your input for the sole purpose of delivering the Service to you. We may use anonymised, aggregated, non-identifiable usage data to improve the platform.

Third-party IP: AI outputs may incorporate or reflect content that is subject to third-party intellectual property rights. You are responsible for ensuring your use of AI outputs complies with applicable copyright and IP laws.

9. Privacy & Data

Our collection, use, and storage of your personal data is governed by our Privacy Policy, which forms part of these Terms. By using Clarix, you consent to the data practices described in the Privacy Policy.

Key points:

• We collect your name, email, and profile data via Google Sign-In
• We store usage statistics and preferences in Google Firestore
• We detect your country using your IP address at sign-in (country code only, stored on your profile)
• We use Google Analytics 4 for platform analytics
• Your prompt text is sent to AI providers for processing and is NOT permanently stored by Clarix

10. Payments & Refunds

Paid plans are currently under development and not yet active. When activated:

• Payments will be processed securely by Razorpay — Clarix does not store card or UPI details
• All prices are in Indian Rupees (₹) inclusive of applicable taxes
• GST at the applicable rate will be charged on all paid plans
• Subscriptions are billed monthly and auto-renew unless cancelled
• You may cancel anytime from your Profile page

11. Service Availability & Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, to the extent permitted by Indian law.

• We do not guarantee 100% uptime or uninterrupted service availability
• We may perform maintenance that temporarily affects availability — we will endeavour to minimise disruption
• We are not responsible for outages caused by third-party AI providers (Google, Groq, Anthropic)
• Features may be added, modified, or removed at our discretion with reasonable notice

12. Limitation of Liability

To the maximum extent permitted by the laws of India, Clarix and its operators shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of data, profits, goodwill, or business opportunities
• Damages arising from your reliance on AI-generated content
• Damages arising from unauthorised access to your account due to your own negligence

Our total cumulative liability to you shall not exceed the total amount paid by you to Clarix in the 30 days immediately prior to the event giving rise to the claim. For free-tier users, our liability is limited to ₹0 to the extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless Clarix, its operators, directors, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of Clarix to generate or distribute unlawful content
• Your violation of any third-party rights

14. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if:

• You violate these Terms or our Acceptable Use Policy
• We are required to do so by law or court order
• Your use poses a security or legal risk to Clarix or other users

You may delete your account at any time by emailing support@clarix.digital. Termination does not entitle you to any refund of unused paid subscription days unless our Refund Policy states otherwise.

15. Changes to Terms

We may update these Terms at any time. We will notify you of significant changes by:

• Updating the "Last updated" date at the top of this page
• Showing an in-app notification for material changes

Continued use of Clarix after changes constitutes your acceptance of the revised Terms. If you do not agree to revised Terms, please stop using Clarix and request account deletion.

16. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, including but not limited to:

• Information Technology Act 2000 and its amendments
• Digital Personal Data Protection Act 2023
• Consumer Protection Act 2019
• Indian Contract Act 1872

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
